1. Agreement to Terms

By accessing or using DayInspire ("the Service"), you agree to be bound by these Terms of Service ("Terms"). We've written these Terms to be as clear as possible about how DayInspire works and what we each expect from this relationship.

2. Description of Service

DayInspire is a supportive community platform that provides:

• AI-powered encouragement and supportive messaging
• Community forums for peer support
• Tools to help users through life's challenges

Important: DayInspire is not a substitute for professional medical, mental health, or emergency services. If you are experiencing a crisis or emergency, please contact appropriate emergency services or crisis hotlines immediately.

3. AI Coach Feature

DayInspire offers an AI-powered coaching feature ("AI Coach") that provides supportive conversation and general guidance. By using the AI Coach, you acknowledge and agree to the following:

3.1 Not a Licensed Professional

AI Coach is an artificial intelligence system, not a licensed therapist, counselor, psychologist, psychiatrist, medical doctor, attorney, financial advisor, or any other licensed professional. AI Coach does not hold any professional licenses or certifications. Any references to "coaching" or "domain expertise" describe the AI's general knowledge base, not professional qualifications.

3.2 Not Professional Advice

AI Coach responses are for general supportive and informational purposes only. They do not constitute:

• Medical or health advice
• Mental health diagnosis or treatment
• Legal advice or counsel
• Financial or investment advice
• Career counseling from a certified professional
• Any other professional advice

You should always verify any guidance from AI Coach with appropriately licensed professionals before making important decisions regarding your health, finances, legal matters, or other significant life choices.

3.3 AI Limitations

AI Coach is powered by artificial intelligence and may:

• Provide incorrect, incomplete, or outdated information
• Misunderstand your situation or context
• Give responses that are not appropriate for your specific circumstances
• Be unavailable due to technical issues

AI Coach does not have access to your medical records, legal documents, financial accounts, or other personal information beyond what you share in conversations.

3.4 Third-Party AI Services

AI Coach is powered by third-party artificial intelligence services, including Anthropic (Claude). Your conversations may be processed by these services in accordance with their respective privacy policies. We do not control and are not responsible for the AI models' underlying behavior.

3.5 Crisis Situations

AI Coach is not equipped to handle mental health crises or emergencies. If you are experiencing thoughts of self-harm, suicide, or are in crisis, please immediately contact:

3.6 Limitation of Liability for AI Coach

By using AI Coach, you acknowledge and agree that DayInspire is not liable for:

• Decisions you make based on AI Coach conversations
• Actions you take or fail to take based on AI Coach guidance
• Any outcomes resulting from following AI Coach suggestions
• Emotional distress or other harm related to AI Coach interactions
• Reliance on AI Coach instead of seeking professional help

AI Coach is provided as a supportive tool, not a replacement for professional guidance. You use AI Coach at your own discretion and accept responsibility for how you apply its suggestions.

4. Eligibility

DayInspire is designed for adults. You must be at least 18 years old to use DayInspire independently. Users ages 13-17 may use the Service with verifiable parental or guardian consent.

We do not knowingly collect personal information from children under 13 years of age in compliance with COPPA (Children's Online Privacy Protection Act). By using the Service, you represent that you meet these age requirements and have the legal capacity to enter into these Terms.

5. Account Registration

To access certain features of the Service, you may need to create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

6. User Conduct

You agree to comply with our Community Guidelines and to use the Service only for lawful purposes. You agree not to:

• Post content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Impersonate any person or entity
• Upload viruses or malicious code
• Attempt to gain unauthorized access to the Service or related systems
• Use the Service to harm minors in any way
• Violate any applicable laws or regulations

7. User Content

You retain ownership of any content you submit to the Service ("User Content"). By submitting User Content, you grant DayInspire a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content in connection with the Service.

You are solely responsible for your User Content. We reserve the right to remove any User Content that violates these Terms or our Community Guidelines.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Intellectual Property

The Service and its original content (excluding User Content) are and will remain the exclusive property of DayInspire. The Service is protected by copyright, trademark, and other laws.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free, though we strive to provide reliable service.

Not Professional Advice: Content provided through DayInspire, including AI-generated messages, is for general supportive purposes only and does not constitute medical, mental health, legal, or other professional advice. Always seek the advice of qualified professionals for specific concerns.

11. Limitation of Liability

In plain language: We work hard to provide a helpful service, but if something goes wrong, we can't be held responsible for knock-on effects. We encourage you to use DayInspire as one of many tools in your support system.

To the maximum extent permitted by law, DayInspire shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

12. Termination

We hope you'll be part of the DayInspire community for a long time. However, if you violate these Terms or engage in behavior that harms our community, we may need to suspend or terminate your access to protect other users.

When possible, we'll try to communicate with you about any concerns before taking action. However, we reserve the right to act immediately if necessary for safety reasons or serious violations. You may also delete your account at any time through your account settings.

Appeals Process

If you believe your account was suspended or terminated in error, you may appeal by emailing appeals@dayinspire.com within 30 days. Please include:

• Your account email address
• A brief explanation of why you believe the decision was incorrect
• Any relevant context we should consider

We review all appeals fairly and will respond within 14 days. Our decision on appeals is final.

13. Indemnification

In plain language: You're responsible for how you use DayInspire. If your actions cause problems for us or others, you agree to help make things right.

Specifically, you agree to indemnify and hold harmless DayInspire and its team from claims, damages, or expenses arising from:

• Your use of the Service, including AI Coach
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit to the Service
• Any decisions or actions you take based on AI Coach interactions

14. Dispute Resolution

We hope we never have a disagreement, but if we do, we'd like to resolve it fairly and efficiently. Here's how disputes are handled:

Let's Talk First: Before starting any formal process, please reach out to us at support@dayinspire.com. Many issues can be resolved through a simple conversation.

Arbitration: If we can't resolve things informally, disputes will be settled through binding arbitration (a private process, often simpler than court) under the rules of the American Arbitration Association. You may still use small claims court if your claim qualifies.

Individual Resolution: Disputes will be handled individually, not as part of a class action or group proceeding.

Your Choice: You may opt out of arbitration by emailing support@dayinspire.com within 30 days of creating your account.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any legal proceedings arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Florida.
